Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the GiftPays platform and the purchase, delivery, and redemption of digital gift cards. By using GiftPays or completing a purchase, you agree to be legally bound by these Terms.

1. Service Description

GiftPays provides digital gift cards that are delivered electronically via email. No physical products are shipped. Once a gift card has been successfully delivered, it is considered used and cannot be refunded or cancelled.

2. Eligibility

You must be at least 18 years old to use our services.

3. Payments & Pricing

All prices are displayed in EUR and include applicable taxes unless stated otherwise. Payments are processed securely by our payment provider Viva Wallet. GiftPays does not store any card or payment details and is not responsible for technical failures or outages of the payment provider.

4. Gift Card Usage

Each gift card contains a unique digital gift code. The recipient is responsible for keeping this code secure. GiftPays is not liable for loss, misuse, or unauthorized access to a gift code after delivery.

5. Refund Policy

Due to the digital nature of the product and in accordance with §356(5) BGB and Article 16(m) of Directive 2011/83/EU, the right of withdrawal expires once the digital content has been delivered, provided that the customer has expressly agreed to this prior to purchase.

6. Limitation of Liability

GiftPays shall not be liable for indirect or consequential damages arising from the use of our services.

7. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, with the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as legally permissible.
